The City of Needles will be holding the last public hearing workshop regarding proposed increases in services and rates for handling solid waste and recycling in Needles, California on Wednesday, February 20th, 2019.
The workshop will at 12:00 p.m. PT inside the Needles City Council Chambers at the Needles Civic Center, located at 1111 Bailey Avenue near J Street, in Needles, California, and will offer details and answer questions about proposed contractual changes with Republic Services, Inc., also known to the City of Needles as Allied Waste Transportation, Inc. or “Allied”, to meet state mandates for recycling.
Parking is located around the Needles Civic Center just off of J Street near the Needles Recreation Center or just off of Bailey Avenue near the San Bernardino County Needles Branch Library building.

- Concerning Proposed Increases in Rates for City Solid Waste and Recycling Handling Services:
Notice is hereby given that the City Council will conduct a public hearing at a regular meeting to be held on March 12, 2019 at 6:00 PM, or as soon thereafter as the matter may be heard, at the Council Chambers, 1111 Bailey Avenue, Needles, California, to consider adopting increases to the rates for its solid waste and recycling handling services.
- Why are you receiving this notice?
This notice is being furnished to you by the City of Needles pursuant to California Constitution Article XIIID (also known as “Proposition 218”). Under the terms of Proposition 218, the City is required to notify property owners of proposed changes to property-related fees such as Solid Waste and Recycling Services. This serves as notice that the City Council will hold a public hearing at the above-mentioned date, time, and location to consider changes to its current solid waste and recycling handling services.
- Why are rate increases required?
The City Council is dedicated to providing residents with reliable, high-quality and cost effective solid waste and recycling handling services, including operations and maintenance, debt service and a provision for a prudent reserve, and funding for future capital projects. The City’s legal mandate is to provide refuse removal services in compliance with local, state and federal laws and regulations. The City’s goal is to meet all legal requirements while providing dependable and high-quality service to our customers. By way of this notice, the City is proposing an amendment of and extension to its Exclusive Franchise Agreement with Allied Waste Transportation, Inc. (“Allied”) that will provide for enhanced solid waste and recycling handling services for City’s customers (“Fourth Amendment”). Through Allied, the City provides a range of solid waste and recycling handling services. The fees charged by Allied include the costs for collection, transportation and handling of solid waste and construction debris for commercial, industrial and residential properties within the City limits. Allied additionally provides for collection, transportation and handling of recyclable materials at no charge. However, due to increased costs, including a state mandate that the City establish a mandatory recycling program for all commercial accounts, those fees need to be increased. The rates associated with services provided by Allied have increased for reasons including, but not limited to, to the following: (1) Compliance with state-mandated diversion and recycling requirements, including but not limited to those set forth in California Assembly Bills 341 and 1826; (2) Increases in recycling processing costs due to dramatic shifts in the recycling commodities market caused in large part by recent changes in Chinese policy commonly referred to as “China Sword.” PROPOSED NEW SOLID WASTE AND RECYCLING HANDLING RATES (EFFECTIVE APRIL 1, 2019) The amount of the solid waste and recycling handling services rate is calculated based on each customer’s solid waste and/or recycling container size as well as the frequency of collection.

- Annual adjustment of service rates:
An annual rate adjustment will take effect on January 1st of each year, commencing in 2020, in an amount equal to the percentage increase in the Consumer Price Index for All Urban Consumers (Water, Sewer and Trash Collection Services) U.S. City Average, as published by the United States Department of Labor, Bureau of Statistics (the “CPI”). For the CPI calculation, rates will be adjusted using the period of Nov 1st to Oct 31st. In addition to the above new rates, the following rates are currently in place, and will be affected by the proposed CPI increase commencing on January 1, 2020;

- Proposed term of the fourth amendment:
The proposed Fourth Amendment would extend the Exclusive Franchise Agreement through July 1, 2028. Thereafter, the Exclusive Franchise Agreement may be renewed for two successive five-year terms upon mutual consent of the City and Allied.
- Franchise fee:
The Franchise Agreement includes an obligation by Allied to pay the City a franchise fee as compensation for the exclusive right to collect solid waste within the city boundaries and the right to use city streets for conducting this business.
- Administrative charges:
Included in the sanitation rates is an administrative charge to pay for costs incurred by the City in connection with the solid waste services, including but not limited to, recycling management and education, household hazardous waste collection and education, street sweeper maintenance, billing and collection, and a proportionate share of other city administrative overhead.
- What will happen at the public hearing?
The City Council will hear and consider all written and oral protests to the proposed rate increases at the Public Hearing. Oral comments at the Public Hearing will not qualify as formal protests unless accompanied by a written protest. Upon the conclusion of the Public Hearing, the City Council will consider adoption of the proposed rate increases for the solid waste and recycling handling services described herein. If written protests against the proposed solid waste and recycling handling services outlined above are not presented by a majority of the property owners or customers of record of the identified parcels upon which the rates are proposed, the City Council will be authorized to impose the rate increases.
- How can I participate?
The City of Needles welcomes your input as City Council considers the changes explained in this notice. If you have any questions or comments, you can:
- Attend: The City staff will conduct public workshops on the solid waste and recycling handling rates (times and dates posted above).
- Write: Any property owner or any tenant directly responsible for the payment of solid waste and recycling handling fees may submit a written protest to the proposed increases; however, only one protest will be counted per identified parcel. Any written protest must: (1) state the specific rate increase for which the protest is being submitted in opposition; (2) provide the location of the identified parcel (by assessor’s parcel number or street address); and (3) include the name and signature of the property owner or customer of record submitting the protest. A written protest may be submitted by mail or in person to the: City Clerk at City of Needles, 817 Third Street, Needles, California 92363, or at the Public Hearing, so long as they are received prior to the conclusion of the public input portion of the Public Hearing. Any protest submitted via e-mail or other electronic means will not be accepted. Please identify on the front of the envelope for any written protest, whether mailed or submitted in person to the City Clerk, that the enclosed protest is for the Public Hearing on the Proposed Increases for solid waste and recycling handling services. Please note: A protest may not be filed if your property does not have access to solid waste or recycling services. Therefore if you received this notice in error please disregard. Thank you.
