A public hearing to consider all evidence and testimony for or against approval of a Conditional Use Permit for a marijuana Testing/Lab Facility at 1410 and 1414 W. Broadway, also known as APN 0185-155-13 and 14.

Approve the Findings of Facts and Resolution No. 01-09-2019 PC recommending approval of a Conditional Use permit for a marijuana Testing/Lab Facility at 1410 and 1414 W. Broadway, also known as APN 0185-155-13 and 14.

Before voting on this agenda item, a presentation was held on the property and the building that the marijuana testing and lab facility would be placed, located at 1410 West Broadway and 1414 West Broadway in Downtown Needles, California.

Background: The applicant, Juan D Abravanel Berdugo, representative for U.S. Cannabis Laboratories, has submitted an application for a Marijuana Laboratory Testing Facility Conditional Use Permit at 1410-1414 W. Broadway. The site is comprised of two parcels, with a combined size of .35 acres. Parcel one includes an 1,152 square foot building housing the laboratory testing facility, and parcel two provides the parking for the site.

Tenant improvements to the existing building will be minimal, maintaining the configurations used by the previous tenants, an insurance agency and hair salon.

These improvements include modification of a room for secure storage, a sample preparation room, two rooms for testing, and an ADA compliant bathroom.

The applicant proposes the installation of a 6′ tall wrought iron fence along the street frontage of both parcels, and wrought iron sections are proposed to be installed on top of the existing block wall that runs along the west property line to create a minimum 6′ tall fence.

The building is planned to remain the same color. Because the existing parcels are solid concrete, landscaping will be applied to the front of the building, including small trees and/or bushes selected from the City’s landscape Ordinance.

The proposed Laboratory Testing facility will employ two (2) employees and will operate from 7 a.m. to 9 p.m., 14 hours a day, seven days a week. Vehicle trips per working day will vary; the State requires that the testing lab pick-up the product to be tested at the site of the distributor The applicant has filed paperwork for the required ISO/IEC 17025 accreditation through Perry Johnson Laboratory Accreditation, Inc.

The State will allow the testing lab facility to operate while undergoing the accreditation process, which is expected to take about one year On January 10, 2017, the City Council adopted Ordinance No. 588 AC, allowing Laboratory Testing of marijuana in zones C-1, C-2, C-3, M-1 and M-2 with the approval of a Conditional Use Permit and a Regulatory Permit.

This parcel is zoned General Commercial (C-2). Conditional Use Permit Findings.

In accordance with Section 94.07, the Planning Commission must make the following findings for a Conditional Use Permit:

1. That the requested permit is within its jurisdiction according to the table of permissible uses.

2. The application is complete.

3. The use is consistent with the General Plan.

4. The use will be in harmony with the area in which it is to be located.

5. The use will not materially endanger the public health or safety.

6. The use will not substantially injure the value of adjoining or abutting property.

7. That the project overall is consistent with the preceding findings.

Critical Timeline: The applicant’s anticipated timeline is to be in production as soon as possible.

Fiscal Impact: 1. 2. 3. The 10% of gross sales of marijuana business tax (voter approved (2012) Valuation of new buildings – added to city tax rolls. NPUA-electric/water/sewer usage revenue. Recurring business license and permitting fees. A 25% State tax – a portion of which will be passed to local government, as enacted from approval of Proposition 64 in November 2016. Statewide 10% sales tax, the city’s share is 1%. 5. 6.

Environmental: This project is categorically exempt under the California Environmental Quality Act, CEOA Guidelines, Section 15301(a), (Existing Facilities, interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances). The proposed use will involve tenant improvements to an existing building facility.

Recommendation: Approve Resolution No. 01-09-2019 PC recommending approval of a Conditional Use Permit for a Marijuana Laboratory Testing Facility located at 1410-1414 W. Broadway, also known as APN 0185-133-13/14.

Afterwards, members of the Needles Planning Commission discussed the proposal marijuana testing and lab facility with the applicants of the marijuana testing and lab facility.

During discussion, the applicants talked about themselves and their job background, talked about what will be going on there inside the marijuana testing and lab facility and mention their plans; staying at this building temporary and as building grows, go to another property to expand. 

A question during public appearance asked if they (applicants) are going to be at that building temporary until they need to expand, why not go to a place or building that is large enough already. The applicants of the marijuana testing and lab facility said that they want to see who things do well at this location, then grow when business grows regarding marijuana testing and lab demand.

Another concern brought up during discussions was the location of the proposal marijuana testing and lab facility, being right along West Broadway in Downtown Needles, California which many in the community have expressed they want to see more retail in downtown, not marijuana. 

After discussing this agenda item, members of the Needles Planning Commission voted unanimously to approve the Findings of Facts and Resolution No. 01-09-2019 PC recommending approval of a Conditional Use permit for a marijuana Testing/Lab Facility at 1410 and 1414 W. Broadway, also known as APN 0185-155-13 and 14.

The agenda item will be place on the agenda for members of the Needles City Council to discuss and to either vote for or against at their next Needles City Council Meeting, which is scheduled for 6:00 p.m. PT on Tuesday, January 22nd, 2019.
