Members of the Needles City Council will be discussing and possibly voting on a resolution regarding fire department services for Needles, California, annexations, and the San Bernardino County Fire Protection District.

The agenda item, Agenda Item #14, will be brought up during the Needles City Council and Needles Public Utility Authority Meeting being held at 6:00pm PT on Tuesday, December 8th, 2015 inside the Needles City Council Chambers located on the 1700 block of J Street near the Needles Recreation Center and Bailey Avenue in Needles, California.

– Agenda Item #14:

Resolution No. 2015-51 authorizing the filing of an application to the Local Agency Formation Commission (L.A.F.C.O.) to initiate proceedings for a sphere of influence amendment (expansion) of the San Bernardino County Fire Protection District and reorganization to include annexations to the San Bernardino County Fire Protection District, its South Desert Service Zone and Service Zone.

According to the City of Needles, as a result of the annexation, Local Agency Formation Commission (L.A.F.C.O.) will permanently transfer enough of the Cityof Needles’ property tax base to cover the cost of providing fire service for the first year. After that the Fire District will be responsible for any fluctuations in their cost, but the City of Needles’ contribution will be capped at whatever percentage of the tax base shifted during the first year. At the current rate there would be a $582,000 transfer or 73% of the City of Needles’ tax base in 2015-16. If the City of Needles concurrently annexes into one of the Fire Protection districts that levies a parcel tax, the property tax base shift would be reduced by the amount that the parcel tax would generate.

The attached resolution is the City of Needles’ formal request and application to Local Agency Formation Commission (L.A.F.C.O.) to annex into the San Bernardino County Fire Protection District. The Needles City Council needs to make a determination as to whether the City will annex into the FP-5 or FP-6 service zone setting the parcel tax rate or if no parcel tax will be applied. Local Agency Formation Commission (L.A.F.C.O.) is using 2,769 parcels in Needles, California with the 2016 tax overlays as follows:

FP-5 Helendale/Silver Lakes = $143.92 x 2,769 = $398,514 parcel tax contribution FP-6 Havasu Lake = $127.74 x 2,769 = $353,712 parcel tax contribution

Annual cost to annex into the fire district is $582,000, therefore, based on the above tax overlays, Needles’ contribution from our property tax revenues would be:

FP-5 = $183,486

FP-6 = $228,288

No parcel tax applied = $582,000

Additionally, the resolution references the attachment of our application, however, staff is diligently working to complete the application which we will provide to the Needles City Council prior to Tuesday’s Needles City Council Meeting.

As for fiscal impact, upon completion of the annexation process, the general fund impact would be $183,486, $228,288 or $582,000 depending on the options above

The recommended action, waive the reading and adopt Resolution No. 2015-51 authorizing the filing of an application to the Local Agency Formation Commission (L.A.F.C.O.) to initiate proceedings for a sphere of influence amendment (expansion) of the San Bernardino County fire Protection District and reorganization to include annexations to the San Bernardino County Fire Protection District, its South Desert Service Zone and Service Zone FP.
