Las Vegas, NV: The surveillance video from the Drai’s nightclub shooting in Las Vegas, Nevada was released Wednesday.
The surveillance video from a nightclub shooting at the Drai’s nightclub inside the Bally’s Hotel and Casino in Las Vegas, Nevada has been released to the public Wednesday.
A person was killed and a total of 3 people were shot when a gunman opened fire inside the Drai’s nightclub on Monday, October 21st, 2013.
According to the Las Vegas Metropolitan Police Department, at around 5:30am PT on Monday, October 21st, 2013, the suspect identified as 41 year old Benjamin Frazier (Benjamin Frazier’ Mug Shot Picture Obtain From The Las Vegas Metropolitan Police Department) reportedly was leaving his identification with a hostess while he checked out the club.
Benjamin Frazier returned to pay the $30.00 cover charge then reportedly changed his mind and became confrontational with a nightclub doorman which he is seen eventually throwing the doorman to the ground.
Benjamin Frazier then pulled out a gun and shot the nightclub doorman in the arm area and the round from the .38-caliber revolver also hit the nightclub doorman in the chest area.
Benjamin Frazier then shot in the stomach a security guard who later collapsed a few feet away.
Benjamin Frazier then left the nightclub randomly pointing the gun, but that is when a nightclub patron identified as Kenneth Brown was seen running up from behind and tackling Benjamin Frazier from the side then wrestling Benjamin Frazier to the ground.
Benjamin Frazier reportedly hits his head when both Kenneth Brown and Benjamin Frazier fell to the ground.
According to the Las Vegas Metropolitan Police Department, The gun reportedly appears to have gone off while the 2 people were on the ground.
Kenneth Brown and 2 other people, and Benjamin Frazier were taken to University Medical Center in Las Vegas, Nevada for treatment, but Kenneth Brown did not survive the shooting.
According to Clark County District Attorney Steve Wolfson, “Anytime someone uses a gun and fires a gun, whether it is involving our locals or our tourists, we’re going to take it very seriously.”
Steve Wolfson is still considering whether to seek the death penalty against Benjamin Frazier and says that the video holds many answers.
“It is one thing to imagine what happened, but if you had the video that shows with clarity what happened, it is good for everybody,” said Clark County District Attorney Steve Wolfson.
Benjamin Frazier’s Attorney Robert Beckett tells Fox affiliate KVVU Channel 5 that the surveillance video doesn’t tell the whole story on what was going on inside Benjamin Frazier and that Benjamin Frazier was taking 3 types of anti-depression medications and 2 types of blood presser medications at high levels yet drunk a large amount of alcohol as well.
Robert Beckett was reportedly a Former Nye County District Attorney until he was ousted in 2010 and is Benjamin Frazier’s cousin and attorney.
In regards to the gun going off on Kenneth Brown, “We do not know at this point rather the gun when off, if he intentionally shot, or if the gun went of accidentally during the struggle,” said Benjamin Frazier’s Attorney Robert Beckett telling Fox affiliate KVVU Channel 5.
The surveillance video from a nightclub shooting will be used by the prosecution and Benjamin Frazier’s defense as he stands trial for murder in the nightclub shooting.
Benjamin Frazier was convicted in 1997 of a felony, assault with a deadly weapon, in a plea deal stemming from a June 1996 incident at a Las Vegas, Nevada club.
Benjamin Frazier completed a sentence of 2 years of probation, performed community service, and took impulse control classes.
Benjamin Frazier has pleaded not guilty to the charges in the nightclub shooting.
A judge will set Benjamin Frazier’s court trial date on Saturday, January 18th, 2014.
