Needles City Council Voted In Favor of a Recommendation Regarding the El Garces Project.

Downtown Needles, CA: A three year delay on the El Garces Project may be coming to an end after last Tuesday’s Needles City Council Meeting and a vote on a recommendation on the El Garces Project in Downtown Needles, California.

The recommendation was made during a Needles City Council Meeting agenda updating the Needles City Council on the El Garces Project, the Joint Development Agreement with El Garces LLC, the Federal Transit Administration (FTA), Omnitrans, and funding for the El Garces Project.

El Garces Project Manager Allan Affeldt with Daniel Lutzick of El Garces LLC told the Needles City Council that the Federal Transit Administration (FTA), “Didn’t see any particular reason why you couldn’t proceed with the project (El Garces Project).”

But in regards to a Joint Development Agreement that would of transfer the title from El Garces to a private entity such as El Garces LLC, the Federal Transit Administration (FTA) said in a letter to Omnitrans requiring additional information.

A conference call was held on Thursday, March 8th, 2012 with the City of Needles and Omnitrans representatives, including legal counsel for both agencies, and El Garces LLC.

During the course of the discussion, it was pointed out by the County of San Bernardino counsel that it will most likely be very difficult to get the Federal Transit Administration (FTA) to agree to transfer the property to El Garces LLC and Project Manager Allan Affeldt felt it will be very difficult to get required financing for the commercial portion without such a transfer.

El Garces Project Manager Allan Affeldt suggested that the best course of action at this time would be for the City of Needles to proceed with the Intermodal Transit Facility (Non-Commercial Portion of the El Garces Project) and then construction of the commercial portion of the El Garces Project can be dealt with separately at a later date.

El Garces Project Manager Allan Affeldt with Daniel Lutzick of El Garces LLC told the Needles City Council that they recommended the City of Needles to proceed with the Non-Commercial aspect of El Garces Project.

“Our recommendation is that you should proceed with the project as expeditiously as possible,” said El Garces Project Manager Allan Affeldt.

El Garces Project Manager Allan Affeldt also told the Needles City Council that the Federal Transit Administration (FTA) doesn’t have to sign off on the Joint Development Agreement for the El Garces Project.

El Garces Project Manager Allan Affeldt informed the Needles City Council that they would just need to send a letter to the Federal Transit Administration (FTA) saying that City of Needles understands that the money can only be used for non-commercial aspect of the El Garces Project.

As for Omnitrans, El Garces Project Manager Allan Affeldt told the Needles City Council that Omnitrans is ready to release the funds so that you can resume the project.

After hearing the recommendation regarding the El Garces Project by El Garces LLC., the Needles City Council agreed with the recommendation and voted 6 to 0 in favor of the recommendation by El Garces Project Manager Allan Affeldt and Daniel Lutzick of El Garces LLC to proceed with the Non-Commercial aspect of El Garces Project.

The Needles City Council thanked both El Garces Project Manager Allan Affeldt and Daniel Lutzick of El Garces LLC for getting the City of Needles to this point in the project.
