Needles City Council Votes on Ballot Measure Proposal to Tax Marijuana Businesses.

Needles, CA: At last Tuesday’s Needles City Council Meeting, council members discuss a ballot measure proposal to tax marijuana businesses and to place that ballot measure onto the Special Municipal Primary Election which will be held on Tuesday, June 5th, 2012.

Needles City Councilmember Linda J. Kidd told the Needles City Council that the subcommittee, “Decided to go forward with the marijuana business tax; it is a revised version of our previous medical marijuana ordinance that gives us the authority to audit the books medical marijuana dispensaries and applied up to 10% tax.”

The ordinance was modeled after the San Jose, California’s ordinance which taxes medical marijuana sales at 7% and raised in the 1st month of the ordinance $290,000 according to Needles City Attorney John Pinkney.

Needles City Attorney John Pinkney also told the Needles City Council that this ordinance has, “Teeth in this ordinance; for those who don’t, a 25% penalty. If they continue, then there is a second 25% penalty plus interest on the tax too.”

“This ordinance does not make any illegal activity lawful or temp to do that anyways,” said Needles City Attorney John Pinkney.

After the discussion on this item, the Needles City Council unanimously voted 6-0 to approve the ballot measure proposal to tax marijuana businesses and will held place on the Special Municipal Primary Election which to be held on Tuesday, June 5th, 2012.

– Background Information:

Request for council’s consideration to call a special municipal election on June 5th, 2012 (Primary) consolidating with the county of San Bernardino to place a marijuana business tax measure on the ballot. The estimated cost to call a special election would be $3,000 however the cost may be significantly higher or sometimes lower than the estimate provided by the Registrar of Voters. If the city were to place this measure at our regular November 2012 election the estimated cost would be $700 to $1,000.

– Fiscal Impact:

Estimated cost to General Fund $3,000.

According to the Marijuana Business Tax Ballot Item on the Tuesday’s Needles City Council Agenda, the Marijuana Business Tax Ballot reads,

“In order to provide funding for essential City services such as police, fire, emergency response, street maintenance, pothole repair, parks, libraries and youth and senior programs, shall an ordinance be adopted to impose a tax at a rate of up to 10% of gross receipts on marijuana businesses in Needles, subject to existing independent financial audits, with all revenue controlled by the City?”
